End User License Agreement
The terms that govern your access to and use of the PoolPro mobile application.
By accessing or using the PoolPro mobile application, you agree to be bound by this End User License Agreement and these Terms of Service.
1. Acceptance of Terms
By accessing or using the PoolPro mobile application (“App”), you agree to be bound by this End User License Agreement and these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and PoolPro.
2. Description of Service
PoolPro provides a pool service management platform that enables pool service professionals to manage customers, routes, work orders, service reports, invoicing, scheduling, and team coordination. The App may include features such as chemical calculators, equipment tracking, billing automation, and communication tools.
3. Account Registration
To use the App, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscriptions & Payments
Certain features of the App may require a paid subscription. Subscription fees are billed in advance on a recurring basis, monthly or annually, depending on the plan you select. You authorize us to charge your designated payment method for the applicable fees. Subscription renewals are automatic unless cancelled before the renewal date. Refunds are handled in accordance with the applicable app store policies.
5. User Responsibilities
You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:
- Use the App for any fraudulent or illegal activity
- Interfere with or disrupt the App’s functionality
- Attempt to gain unauthorized access to other accounts or systems
- Upload malicious code, viruses, or harmful content
- Reproduce, modify, or distribute the App without authorization
- Use the App to harass, abuse, or harm other users
6. Data & Content Ownership
You retain ownership of all data, content, and information you input into the App (“User Content”). By using the App, you grant PoolPro a limited license to store, process, and display your User Content solely to provide the services. We do not claim ownership of your customer records, service reports, or business data.
7. Intellectual Property
The App, including its design, code, features, logos, and documentation, is the property of PoolPro and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
8. Third-Party Integrations
The App may integrate with third-party services such as QuickBooks, mapping providers, and payment processors. Your use of these third-party services is subject to their own terms and conditions. PoolPro is not responsible for the availability or accuracy of third-party services.
9. Limitation of Liability
To the maximum extent permitted by law, PoolPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim. The App is provided “as is” without warranties of any kind.
10. Disclaimer of Warranties
PoolPro makes no warranties, express or implied, regarding the App’s reliability, accuracy, availability, or fitness for a particular purpose. Chemical calculations, scheduling suggestions, and other automated features are provided as tools only and should be verified by qualified professionals.
11. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. You may export your data prior to termination. We may retain certain data as required by law.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration.
